DevSpeak Utilities

DevSpeak Utilities (https://utilities.devspeak.dev) is a suite of four developer tools (SpecStudio, Prompt Guardian, Dev Text Forge and PromptForge) and one paid plan, Utilities Pro, provided by Devspeak S.A.S., a Colombian company (Cll. 7D # 43A - 40, Piso 8, Medellín, Antioquia 050022, Colombia), under the DevSpeak Labs brand. These Terms of Service are an agreement between you and Devspeak S.A.S. and apply to the apps, the suite page and Utilities Pro (together, the Services).

By creating an account, signing in or using the Services you accept these Terms and our Privacy Policy. You must be at least 18 years old and able to enter into a contract. If you use the Services for an organisation, you confirm that you may accept these Terms on its behalf.

Each app has free features. Utilities Pro adds paid features in all four apps under one subscription. We may add, change or remove features. If we stop offering Utilities Pro, we will refund the unused part of any prepaid period.

Give accurate information, keep your password private and tell us at info@devspeak.dev if you think someone else used your account. You are responsible for activity under your account. One person may not hold several accounts to get more trials or free usage.

Many features send your text to third-party AI models, listed in each app's Privacy Policy. AI output can be wrong, incomplete, outdated, biased or insecure, and the same input can produce different output. Outputs are not legal, security, financial or other professional advice.

You are responsible for reviewing and testing any output before you rely on it or use it in code, prompts, specifications, documents or production systems. Findings from security or quality checks (for example in Prompt Guardian) are aids, not a complete assessment or a guarantee that a prompt or system is safe.

We do not use your content to train AI models, and we do not ask our AI providers to train on it.

You keep the rights you have in the text and files you submit and in the output generated for you, to the extent the law allows. You give Devspeak S.A.S. a non-exclusive, worldwide licence to host, copy, process and transmit that content only to provide, secure and support the Services for you.

Only submit content you have the right to use. Do not submit passwords, API keys, other secrets, or sensitive personal data (such as health data) about yourself or others.

You may not use the Services to:

• break the law or infringe anyone's rights, including intellectual property and privacy rights;
• create or distribute malware, phishing, spam, or content that sexualises minors, incites violence or harasses people;
• test, attack or probe prompts, models or systems you do not own or are not authorised to test;
• process other people's personal data without a lawful basis;
• get around usage limits, trial caps, paywalls or security measures, or share an account to avoid paying;
• scrape the Services, overload them, or access them by automated means other than the features we provide;
• copy, resell or reverse engineer the Services, except where the law allows it;
• break the usage policies of the AI providers whose models the feature uses.

We may limit, suspend or close an account that breaks these rules, and remove the content involved. Where reasonable, we will tell you first.

Utilities Pro costs $5.99 per month or $59.99 per year, at the price shown at checkout, which includes applicable taxes. Dodo Payments sells the subscription to you as merchant of record: it processes the payment, issues the invoice and handles sales taxes, and its buyer terms also apply to the purchase.

Subscriptions renew automatically at the end of each monthly or yearly period until you cancel. You can cancel at any time from Settings, Billing in any of the four apps; Utilities Pro stays active until the end of the period you paid for, and you are not charged again.

We will tell you about a price change at least 30 days before it applies to your next renewal, so you can cancel before then.

New accounts can try Utilities Pro free for 7 days without a payment card, once per person. The app shows the trial's usage caps and the days left. When the trial ends your account returns to the free plan automatically and nothing is charged. We may end a trial early if it is used to break these Terms.

Within 14 days of your first payment for a Utilities Pro subscription you may withdraw: email info@devspeak.dev from your account's email address. We cancel the subscription and refund that payment in full to your original payment method through Dodo Payments, and confirm by email.

Other payments, including renewals and partial periods after a cancellation, are not refunded, except where the law requires a refund or where we charged you in error. Nothing in these Terms limits your mandatory rights as a consumer.

We work to keep the Services available but do not promise uninterrupted service. Maintenance, provider outages or security measures can interrupt them, and a model or provider may become unavailable. The Services do not come with a service-level agreement.

The Services, their software and design, and the names and logos of DevSpeak Labs, DevSpeak Utilities and its apps belong to Devspeak S.A.S. or its licensors. We give you a personal, non-exclusive, non-transferable and revocable right to use the Services under these Terms. If you send us feedback, we may use it without obligation to you.

Some features rely on third parties, such as Google sign-in, AI model providers and Dodo Payments. Their terms apply to your use of their services, and we are not responsible for them.

Apart from the commitments in these Terms, the Services are provided as they are and as available. To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose and non-infringement.

To the extent the law allows, Devspeak S.A.S. is not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business opportunities. Our total liability for all claims about the Services is limited to the amount you paid for them in the 12 months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Colombian law, including liability for fraud (dolo) or gross negligence, or your mandatory rights as a consumer.

To the extent the law allows, you will compensate Devspeak S.A.S. for third-party claims and costs caused by content you submit or by your breach of these Terms.

You can stop using the Services at any time and ask us to delete your account at info@devspeak.dev. We may suspend or close accounts that break these Terms. When an account is closed, we delete its data as described in the Privacy Policy. Sections 4, 5, 11 and 13 to 17 survive.

These Terms are governed by the laws of the Republic of Colombia. Before going to court, write to info@devspeak.dev so we can try to resolve the issue directly within 30 days. Disputes will be heard by the competent courts of Bogotá D.C., Colombia, without prejudice to your right as a consumer to use the Colombian consumer-protection authority (Superintendencia de Industria y Comercio) or any mandatory forum or law of your country of residence.

We may update these Terms. The version and date at the top show which version applies. We will tell account holders about material changes by email or in the app before they take effect; if you keep using the Services after that, the new Terms apply.

These Terms and the Privacy Policy are the whole agreement about the Services. If a provision is invalid, the rest stays in force. Not enforcing a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it to a successor of the Services and will tell you.
